Terms and Conditions
Effective date: [EFFECTIVE DATE]
1. Introduction
These Terms and Conditions (“Terms”) govern your use of this website and any telehealth services you access through it. The services are provided by [PLATFORM OPERATOR LEGAL NAME] and the Professionals; HerVybeRX is the brand and referral partner through which you found them. By using this website or the services, you agree to these Terms. If you do not agree, please do not use them.
2. Availability
Services are offered only in states where the Platform Operator and the Professionals are permitted to operate, and are subject to state law and the availability of licensed professionals.
3. Eligibility
You must be at least 18 years old and physically located in a state where services are offered at the time you receive them.
4. Requirements for use
You agree to provide accurate, current, and complete information; to keep only one account; to keep your login credentials private; and not to misuse the website or services, interfere with their operation, or use them for anyone other than yourself unless legally authorized.
5. Consent to telehealth services
By using the services, you consent to receive healthcare services through telehealth, which may include video, phone, secure messaging, and online questionnaires.
6. Privacy
Your use of the website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Your relationship with the Platform Operator
[PLATFORM OPERATOR LEGAL NAME] provides the technology platform and coordinates services. It does not itself practice medicine. Medical services are provided by independent licensed professionals through [AFFILIATED PROFESSIONAL ENTITY NAMES], who use their own professional judgment. HerVybeRX does not provide medical services and is not responsible for medical decisions.
8. Asynchronous telemedicine informed consent
What is telemedicine?
Telemedicine is the delivery of healthcare services using electronic communications, information technology, or other means between a licensed professional and a patient who are in different locations.
What is asynchronous telemedicine?
Asynchronous (“store-and-forward”) telemedicine means your information, such as questionnaire answers, photos, or documents, is collected and later reviewed by a licensed professional, rather than in a live visit. The professional may contact you by phone, video, or message if more information is needed.
Possible risks
Risks include, but are not limited to: information may not be sufficient for an appropriate decision, so you may be asked for more information or referred for an in-person visit; delays due to technology problems; security failures that could compromise privacy despite reasonable safeguards; and a lack of access to your complete medical records, which could lead to errors in judgment. Telemedicine is not appropriate for emergencies.
Your rights and acknowledgements
You understand that you may decline telemedicine at any time and seek in-person care instead; that no specific result is guaranteed; that a professional may decide telemedicine is not right for you; that you are responsible for giving complete and accurate information; and that you should seek in-person or emergency care when needed.
Call, email, and text messaging consent
By providing your phone number and email and checking the consent box, you expressly consent to be contacted by HerVybeRX, the Platform Operator, and the Professionals by phone call, email, and text message (SMS/MMS) about your inquiry, your personal information, appointments, and telemedicine visits. Calls and texts may be sent using an automatic telephone dialing system or a prerecorded or artificial voice, even if your number is on a do-not-call list.
Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. You can revoke consent at any time by replying STOP to any text or by contacting info@hervyberx.com. Unless revoked, your consent lasts for the duration of your inquiry and treatment. Text exchanges with a licensed professional may become part of your medical record; a professional’s first text to you will identify their name and credentials. See our SMS Terms.
Disclaimer
The services are provided “as is.” To the fullest extent permitted by law, HerVybeRX disclaims all warranties, express or implied, regarding the website and services. See our full Disclaimer.
9. Incorporated documents
The following documents are part of these Terms: our Privacy Policy; the Professionals’ Notice of Privacy Practices ([NOTICE OF PRIVACY PRACTICES URL]); and the Consent to Telehealth above.
